(COLDWATER) – A man arrested nine times for drunk driving has entered into a plea agreement for his latest incident.
Branch County Circuit Court officials say 41 year old Jeremy Tomlinson of Three Rivers plead guilty to operating while intoxicated third offense with a fourth time habitual offender sentencing enhancer. The Branch County Prosecutor’s Office agreed to dismiss charges of a second offense of driving while license suspended; and transporting open intoxicants in a vehicle.
A sentence of between 3 and 15 years will be sought for Tomlinson on May 1.
Michigan State Police were called to investigate a suspicious vehicle at 9:30 PM in Coldwater Township on February 15. When they arrived, troopers located the vehicle and the driver in a residential driveway.
As they investigated the situation, troopers established probable cause that Tomlinson was operating a motor vehicle while intoxicated. A preliminary breath test showed his blood alcohol level was at .21 percent.
Tomlinson was arrested and taken to the Branch County Jail on charges of habitual operating while intoxicated tenth offense; driving with a revoked license, and having an open alcoholic container in the vehicle.
Troopers also discovered that Tomlinson was on parole, and that his drivers license was indefinitely revoked due to his prior operating while intoxicated convictions.
