(KALAMAZOO) – The trial of former Fabius Township Supervisor Kenneth Linn is scheduled to continue today in Kalamazoo County Circuit Court.
Linn is facing four charges of first degree criminal sexual conduct, after he allegedly sexually assaulted a beverage cart driver in August 2010.
According to WWMT, testimony on Friday came from Erica St. Clair, a Michigan State Police forensics officers. St. Clair testified that DNA evidence from the victim was tested, and there were inconsistencies and that it was not consistent with Linn’s DNA.
St. Clair says there were multiple people's DNA in the test that was conducted.
Michigan Attorney General Dana Nessell and Kalamazoo County Prosecutor Jeff Getting announced on October 26, 2023 that Linn had been arrested and arraigned on four counts of first degree criminal sexual conduct.
The alleged incident happened in August 2010 in Kalamazoo County following a golf outing held at Sauganash Golf Course in Three Rivers. Linn allegedly had sex with a then 22 year old woman while she was drunk and was unable to give consent. The woman had been operating a beverage cart at the golf outing and Linn bought her drinks. He then drove her to her apartment in Portage where the incident happened.
Linn has maintained the sex was consensual.
A sexual assault nurse performed an exam on the victim the next day. The sexual assault kit was not submitted to the Michigan State Police Forensics Lab until December 2014, and returned to the Portage Police in January 2015.
A year later the kit was sent to a forensics lab in Utah, and in 2021 it was approved to be tested by the Michigan State Police.
